1. Základní ustanovení / General Provisions
CZ: Tato DIVÁCKÁ SOUTĚŽ je odbornou taneční soutěží pořádanou společností YZ s.r.o. Cílem soutěže je podpora tanečního umění a vyhlášení vítěze kategorie "Best Choreography".
EN: This SPECTATOR COMPETITION is a professional dance competition organized by YZ s.r.o. The aim of the competition is to support the art of dance and to announce the winner of the "Best Choreography" category.
2. Mechanismus hodnocení / Judging Mechanism
CZ: Určení vítěze: Vítězem kategorie "Best Choreography" se stává taneční organizace (právnická osoba), jejíž choreografie v rámci DIVÁCKÉ SOUTĚŽE obdrží nejvyšší počet hlasů od diváků. Hlasování: Diváci mohou podpořit své favority zakoupením hlasu. Cena za službu hlasování činí 20 Kč za jeden hlas. Tato úhrada je tržbou Pořadatele za poskytnutou službu hlasovacího systému a technické zajištění DIVÁCKÉ SOUTĚŽE. Zakoupený hlas je nevratný a nelze jej reklamovat v případě, že jím podpořená choreografie nevyhraje, nebo v případě, že se soutěžící choreografie z jakéhokoliv důvodu ze soutěže odhlásí či bude diskvalifikována.
EN: Determination of the winner: The winner of the "Best Choreography" category is the dance organization (legal entity) whose choreography receives the highest number of votes from the audience within the SPECTATOR COMPETITION. Voting: Viewers can support their favorites by purchasing a vote. The price for the voting service is 20 CZK per vote. This payment is the Organizer's revenue for the provided voting system service and technical support of the SPECTATOR COMPETITION. The purchased vote is non-refundable and cannot be claimed if the supported choreography does not win, or if the competing choreography withdraws from the competition or is disqualified for any reason.
3. Výhry v soutěži / Competition Prizes
CZ: Hlavní výhra v kategorii "Best Choreography" činí 15 000 Kč (nebo ekvivalent 600 EUR v případě zahraničních účastníků). Výhra je odměnou za umělecký výkon a propagaci vítězné choreografie. Vítězný subjekt je povinen vystavit Pořadateli fakturu za umělecký výkon a propagaci. Výhra bude vítězi proplacena na základě této faktury.
EN: The main prize in the "Best Choreography" category is 15,000 CZK (or the equivalent of 600 EUR for international participants). The prize is a reward for the artistic performance and promotion of the winning choreography. The winning entity is required to issue an invoice to the Organizer for artistic services and promotion. The prize will be paid to the winner based on this invoice.
4. Daňové a právní náležitosti / Tax and Legal Requirements
CZ: Vzhledem k tomu, že vítězem může být pouze právnická osoba, vztah mezi Pořadatelem a vítězem se řídí obchodněprávními předpisy. Vítěz je povinen vystavit fakturu v souladu s platnými právními předpisy a poskytnout Pořadateli součinnost při vypořádání transakce.
EN: As only a legal entity can be the winner, the relationship between the Organizer and the winner is governed by commercial law. The winner is required to issue an invoice in accordance with applicable legal regulations and provide the Organizer with the necessary cooperation for the settlement of the transaction.
5. Závěrečná ustanovení / Final Provisions
CZ: Pořadatel si vyhrazuje právo měnit tato pravidla. Tato soutěž není hazardní hrou ve smyslu zákona č. 186/2016 Sb., neboť se jedná o prodej hlasovací služby a následné obchodní plnění za umělecký výkon na základě divácké ankety, nikoliv o sázkovou hru o peněžité vklady. Účastník hlasování bere na vědomí, že hlasování je službou, jejímž účelem je vyjádření podpory, a nikoliv investicí za účelem zisku. Pořadatel nenese odpovědnost za konečné pořadí choreografií a hlasujícímu nevzniká nárok na vrácení poplatku v případě, že jeho favorit v soutěži nezvítězí.
EN: The Organizer reserves the right to change these rules. This competition is not a gambling game within the meaning of Act No. 186/2016 Coll., as it involves the sale of a voting service and subsequent commercial compensation for artistic performance based on an audience survey, not a betting game based on monetary deposits. The voter acknowledges that voting is a service aimed at expressing support and is not an investment for profit. The Organizer bears no responsibility for the final ranking of choreographies, and the voter has no right to a refund of the fee if their favorite does not win the competition.
